5. Content and Intellectual Property

You retain ownership of content you upload to PublishFlip. By uploading content, you grant us a worldwide, non-exclusive license to host, store, and display your content as necessary to provide our services.

Our Content

PublishFlip and its content, including but not limited to software, designs, and trademarks, are owned by or licensed to us. You may not use our intellectual property without prior written consent.

6. Payment and Billing

For paid subscriptions:

• You agree to pay all fees associated with your subscription
• Fees are billed in advance on a monthly or annual basis
• All payments are non-refundable except as stated in our refund policy
• We may change pricing with 30 days' notice
• Failure to pay may result in service suspension

7. Termination

Either party may terminate this agreement at any time. We reserve the right to suspend or terminate your account immediately for violations of these Terms. Upon termination, your right to use the service ceases, and we may delete your content after a reasonable period.

8. Disclaimer of Warranties

PUBLISHFLIP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUBLISHFLIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION.

10. Indemnification

You agree to indemnify and hold harmless PublishFlip and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the service. Your continued use of PublishFlip after changes constitutes acceptance of the updated Terms.
